Rental terms

These terms apply to the rental services of Estivus OÜ (Saaresimman).
The binding version is the Estonian one.
1. General
- These rental terms govern the rental relationship between Estivus OÜ (the "Lessor") and the customer (the "Lessee").
- By confirming a booking, the Lessee confirms that they have read and agree to these terms.
2. Booking and confirmation
- A booking is submitted on the website as a request. The rental contract is formed once the Lessor confirms the booking by email.
- The Lessor may decline a booking, for example when the equipment is not available.
3. Prices, payment and security
- Prices are in euros and include VAT unless stated otherwise.
- Payment is made by agreement before or at handover. Delivery and setup are added according to the current price list.
- The Lessor may request a security amount for higher-value equipment.
4. Cancellation and changes
- The Lessee may cancel free of charge up to 7 days before the rental period starts.
- For later cancellations the Lessor may charge up to 50% of the rental price.
- Changes to a booking are possible subject to availability.
5. Handover and return
- Equipment is handed over and returned at the agreed time and place. The Lessee inspects its condition at handover.
- Equipment is returned clean and in the same condition as at handover, normal wear excepted.
- For late return the Lessor may charge an additional rental day for each started 24-hour period.
6. Liability, damage and loss
- The Lessee is responsible for the equipment throughout the rental period, including damage, loss and theft.
- For damaged, lost or unreturned equipment the Lessee reimburses the repair cost or replacement value.
- If returned uncleaned, the Lessor may charge a cleaning fee.
7. Use and safety
- Equipment may be used only for its intended purpose and according to instructions. Subletting is prohibited.
- The tent must be secured per instructions and taken down in strong wind or storms. Open flame inside the tent is prohibited, except through the designated stove jack.
- Food-contact appliances (ice cream and ice machines) must be used following hygiene rules, and the Lessee ensures a proper power supply.
- The Lessee is responsible for safe use of the equipment and for the safety of third parties during the event.
8. Limitation of liability and force majeure
- The Lessor is not liable for indirect damage or loss of profit.
- In case of force majeure, including extreme weather, either party may cancel the booking; amounts already paid are refunded or a new date is agreed.
9. Personal data
- The Lessor processes the Lessee’s personal data to fulfil the booking in accordance with the GDPR. Data is not shared with third parties for marketing purposes.
10. Governing law and disputes
- The rental relationship is governed by the law of the Republic of Estonia. Disputes are settled by negotiation and, failing agreement, by Pärnu County Court.
- In case of conflict between language versions, the Estonian version prevails.
